Summary Judgment Granted in Favor of Colony Insurance

February 1, 2008

Carolyn A. Mathews obtained a summary judgment against Peter Vescio and in favor of Colony in connection with Vescio's claim for damages due to a fall from scaffolding during an inspection of Federated Department Store's clothing storage facility in Houston (this was a Motion to Dismiss in Federal Court that was granted as a Motion for Summary Judgment).  Vescio claimed that Colony's Certificate of Insurance acted as an AI Endorsement naming Federated and therefore Colony (his own liability insurer) was responsible for his bodily injuries that occurred as a result of his fall.
