Our attorneys recognize how important it is for our clients, whether a small retail business or high tech company, to understand the complexity of the rules governing intellectual property, protecting their intellectual property assets, and defending their intellectual property rights. We have represented numerous clients in high profile cases both at the state and federal levels. Our diverse clients have included:

  • Film Distributors
  • Producers
  • Screenwriters
  • Music Publishers

  • Retailers

We have successfully defended clients against claims of copyright infringement, fair use, and works-for-hire. We have assisted U.S. and foreign businesses in their defense against claims of trademark infringement and dilution, as well as federal and state unfair competition law, false advertising law, and cyber piracy. We have also represented many clients in asset purchase agreements and licensing disputes involving intellectual property rights and domain names. Some of our representative actions include:

  • Defending a celebrity blog website in a copyright infringement suit filed by a Hollywood entertainment company involving the protection of photographic images of a celebrity.
  • Representing a local restaurant against trademark claims of diluting a famous restaurant’s brand and service mark.
  • Defending a U.S. reseller of high availability and disaster recovery software to IBM “i-System users” against allegations of false advertising and trade libel by a foreign manufacturer.
  • Representing a licensing group accused of interfering with an endorsement deal and licensing agreement between a 2012 Olympic gold medalist and a famous shoe manufacturer.

In addition, we offer our clients transactional services. We counsel our clients on the acquisition of and protection for their intellectual property and works; negotiate and draft agreements covering the development, transfer and licensing of their rights; and prepare and prosecute applications for copyright and trademark registration.
