Case Against Security Company Dismissed for Waiver of Costs

Tim M. Agajanian and German A. Marcucci resolved a negligent security and assault and battery case for a waiver of costs.

The plaintiffs, who alleged to be prominent clothing manufacturers, sought damages against the company providing security for the building where they were tenants. They alleged that the security personnel, in conjunction with the building’s owners, threatened to use force against the plaintiff and their guests in order to deny them access to the plaintiff’s leased premises. One of the plaintiffs further claimed that one of the security personnel tackled him to the ground, and another security personnel used a Taser on one of the guests. The plaintiffs sought damages of more than $400,000 in actual damages, in addition to pain and suffering and punitive damages.

After engaging in written discovery and deposing plaintiffs, plaintiffs agreed to dismiss their case against the security company for a waiver of costs.
