Defense Verdict Upheld on Appeal

Sedigheh Ansari and Abbas Taheri appealed from a judgment in favor of El Proyecto Del Barrio, Inc. and El Proyecto Del Barrio Foundation. The appellants contended the trial court erred when it failed to instruct the jury that it could consider the failure of respondents to follow their own alleged policies and procedures as evidence of negligence. During trial the defendant contended that the policies and procedures plaintiffs were relying on were not, in fact , the policies and procedures of the defendant. The Court of Appeal found no error in refusing the proffered jury instruction and affirmed the judgment in favor of El Proyecto. The appeal was handled by Edmund G. Farrell, III.

In the case, the plaintiff, a 77-year-old woman, allegedly tripped and fell over a concrete wheel stop located in the disabled parking stall section of a parking lot owned by a not-for-profit medical clinic (“Clinic”) in Winnetka, CA. As a result of the fall, the plaintiff sustained a left arm fracture and two years after her fall, underwent a total shoulder replacement surgery. Notably, there were no witnesses to the fall other than the plaintiff’s son and her 94 year old husband who only saw her as she was falling to the ground, but did not actually see her trip over the wheel stop. The plaintiff filed an original complaint for negligence and premises liability against the clinic and her husband filed a claim for loss of consortium.

After an eight day jury trial which included testimony from two liability experts, two shoulder surgeons, an upper extremity expert, two life care planners, an economist, an architect, and six percipient witnesses, the jury took less than 45 minutes to render a defense verdict in favor of the defendant.

The program will take place at the Walt Disney Concert Hall in downtown Los Angeles.

Edmund G. Farrell, III named 2015 Chair of the PLDF Miscellaneous Professional Liability Committee

Farrell, III has been named 2015 Chair of the Professional Liability Defense Federation (PLDF) Miscellaneous Professional Liability Committee. “PLDF’s mission is to enhance the stature and effectiveness of professional liability defense professionals through education, training and the exchange of information.”

With more than 30 years of experience, Mr. Farrell has devoted his entire career in civil defense litigation. As chair of the Appellate Law group, he has been involved in the handling of over 200 appeals and writ petitions and has argued before the California Supreme Court, the Ninth Circuit Court of Appeals and in all six districts of the Court of Appeal of the state of California. In his capacity as Co-Chair of the Professional Liability practice group, Mr. Farrell has represented attorneys, architects and engineers, insurance brokers and other professionals in the defense of various claims of malpractice, sexual harassment and breaches of fiduciary duties. He also regularly handles matters for the London market.

Mr. Farrell received his B.S from University of California, San Diego and his J.D. from Santa Clara University School of Law.

Edmund Farrell to Speak at ASCDC Annual Seminar for 19th Consecutive Year

LOS ANGELESEdmund G. Farrell, III will speak at the Association of Southern California Defense Counsel’s (ASCDC) 52nd Annual Seminar, to be held from February 28-March 1, 2013 in Los Angeles, California. Mr. Farrell has co-presented the “Year in Review” topic for ASCDC since 1994.

Mr. Farrell will discuss case highlights and hot topics in law from 2012. Panelists will speak on issues of interest to trial and appellate attorneys who defend civil lawsuits. Karl Rove will be this year’s keynote speaker.
