Jean Dalmore to Speak at AGC Construction Conference

NAPLESJean A. Dalmore will speak on a panel at the AGC Surety Bonding and Construction Risk Management Conference to be held in Naples, Florida from February 4-6, 2013. The presentation is titled, “Coping with Climate Change: How to Deal with the Many Legal and Market Restrictions on Contractual Indemnity and Additional Insured Endorsements, and Other Questions about Traditional Risk Allocation.”

The panel of attorneys will discuss two leading examples of state legislation that is expressly intended to restrict traditional risk allocation, including the strategies that contractors have developed to deal with that legislation. The presentation will also include an overview of the many different forms that additional insured endorsements are now taking, and an open discussion of where the construction industry goes from here.

Jean Dalmore to Speak at General Contractors Convention

PALM SPRINGSJean A. Dalmore will speak on construction law at the Associated General Contractors of America (AGC) Annual Convention in Palm Springs, California, being held from March 6-9, 2013.

Ms. Dalmore will speak on “Contractor Controlled Insurance Programs (CCIPs) & Owner Controlled Insurance Programs (OCIPs)” during a ten-minute construction law drill presented with nine others from the USLAW Network’s Construction practice group.

Moving from the Minors to the Majors

Structures are awe-inspiring, magnificent things. They are designed and constructed from a variety of materials to accommodate their intended use and anticipated loads. How materials react when a structure is damaged play a Structures tend to endure events that seemingly should result in catastrophic failures because of safety factors and redundancies in their design and construction.

These safety factors are built into the building codes that establish the minimum design loads for a structure and into the allowable capacities of the materials used in their construction. When a catastrophic failure does occur, a forensic engineering expert must look beyond the obvious and determine why the failure occurred.

When a catastrophic failure occurs, typically someone with very little expertise has identified an “obvious” cause, a trigger, before a qualified, forensic engineering expert steps in. In identifying and documenting what made a structure susceptible to damage, a forensic engineering expert can move an evaluation “from the Minors to the Majors.”

Jean Dalmore Co-Authors Article to be Published by DRI

LOS ANGELES – The Defense Research Institute (DRI) has selected Murchison & Cumming partner Jean A. Dalmore’s co-authored work, “Moving from the Minors to the Majors: Catastrophic Failures,” for publication in the August 2011 issue of its quarterly magazine, For The Defense.

Focusing on the causes of catastrophic construction failures, the article discusses legal issues that need to be addressed during the various stages of litigation, including a discussion of related insurance coverage issues. The work was originally co-authored by Ms. Dalmore, Robert M. Zaralban of forensic analysis company Sea Limited and David H. Kochman of Harris Beach PLLC for DRI’s fall 2010 Construction Law Seminar.

Ms. Dalmore serves as Co-Chair of the firm’s Construction Law practice group. She also serves as Chair of the Special Litigation Group of DRI’s Construction Law Committee and is a frequent speaker and author of articles on topics related to Construction Defect claims and litigation.
